Terms of Service

1.About these terms
These Terms of Service (“Terms”) are an agreement between you and TradeStart (“we”, “us”), the provider of the TradeStart software and website at tradestart.io and app.tradestart.io (the “Service”). By creating an account or using the Service, you agree to these Terms. If you’re agreeing on behalf of a business, you confirm you’re authorised to bind that business.
2.The service
TradeStart is field-management software for trade businesses — managing customers, jobs, quotes and invoices, with GST handling for New Zealand and Australia, PDF/email documents, a mobile view for technicians, and an optional Xero integration. We may add, change or remove features over time.
3.Accounts & eligibility
You must be at least 18 and running or working for a legitimate trade or business to use the Service. You’re responsible for your login details, for all activity under your account, and for keeping your password secure. Tell us promptly at hello@tradestart.io if you suspect unauthorised access. Owners are responsible for any technician logins they create.
4.Free trial
New accounts receive a 14-day free trial with full access and no card required. At the end of the trial, you’ll need an active paid subscription to continue making changes; read-only access to your existing data may be preserved. We may change or withdraw trial terms for future sign-ups.
5.Subscription & billing
- The subscription is NZ$17.99 per month (including GST), billed in advance to your nominated payment method. Australian customers are also billed in New Zealand dollars (NZD).
- Payments are processed by Stripe; we don’t store your full card details. Your use of Stripe is also subject to Stripe’s terms.
- The subscription renews automatically each month until cancelled.
- We may change pricing on reasonable notice; changes take effect at your next billing cycle.
- You’re responsible for any taxes that apply to your purchase beyond GST already stated.
6.Cancellation & refunds
You can cancel any time from your account settings; cancellation takes effect at the end of the current paid period, and you keep access until then. Except where required by law (see section 13), payments are generally non-refundable and we don’t provide partial-period refunds. If you believe you’ve been charged in error, contact us and we’ll look into it.
7.Your data & content
You own the data you put into TradeStart — your customers, jobs, quotes, invoices, logo and business details (“Your Content”). You grant us the limited rights needed to host and process Your Content to provide the Service. You’re responsible for the accuracy and lawfulness of Your Content and for having the right to store the personal information of your own customers. Our handling of personal information is described in our Privacy Policy.
8.Acceptable use
You agree not to misuse the Service, including: breaking the law or infringing others’ rights; uploading malware; attempting to breach security, scrape, or reverse-engineer the Service; overloading our systems; reselling the Service without permission; or using it to send spam or fraudulent invoices. We may suspend accounts that put the Service or other users at risk.
9.Third-party integrations
The Service integrates with third parties including Stripe (payments), our email provider (invoice and system emails), and — if you connect it — Xero. Those services are governed by their own terms, and we’re not responsible for their availability or actions. Connecting an integration authorises us to exchange the relevant data with it on your behalf.
10.Intellectual property
The Service, including its software, design and branding, belongs to TradeStart and its licensors. These Terms don’t transfer any of our intellectual property to you beyond the right to use the Service. Invoices and documents you generate for your own customers remain yours.
11.Disclaimers
The Service is provided “as is”. To the extent permitted by law, we don’t warrant it will be uninterrupted or error-free. TradeStart is a tool, not a substitute for professional advice. GST rates, tax-invoice requirements and calculators (including charge-out rates) are provided as general guidance only — you’re responsible for confirming your tax, GST and accounting obligations with Inland Revenue, the ATO or your accountant.
12.Limitation of liability
To the maximum extent permitted by law, we’re not liable for indirect or consequential loss, or for lost profits, revenue or data. Our total liability arising from the Service in any 12-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability that can’t be limited by law.
13.Consumer law
If you’re in New Zealand, the Consumer Guarantees Act 1993 may apply; if you’re in Australia, the Australian Consumer Law may apply. Where those laws give you guarantees or rights that can’t be excluded, nothing in these Terms limits them. Where the law allows us to limit our liability for a breach of a guarantee, we limit it to re-supplying the Service or paying the cost of re-supply.
14.Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or if required by law. On termination we may delete Your Content after a reasonable period; export your data before you leave if you need it.
15.Changes to these terms
We may update these Terms from time to time. If we make material changes we’ll give reasonable notice (for example, by email or in-app). Continuing to use the Service after changes take effect means you accept the updated Terms.
16.Governing law
These Terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of its courts. If you’re an Australian consumer, this doesn’t deprive you of the protection of Australian law.
